   OpenTV and Double C remain engaged in active settlement discussions with respect to this
   matter. OpenTV and Double C have exchanged term sheets that contemplate a resolution of this
   matter in the context of commercial discussions. The parties have scheduled face-to-face meetings to
   continue negotiations.
   
   Given this progress and the complexity of the issues involved, while there can be no
   assurance that the parties will be able to reach a settlement on the terms being discussed, OpenTV
   and Double C believe that an additional extension of the stay would further the process in which the
   parties are engaged. The parties therefore jointly request continuation of the stay an additional 120
   days, until May 15, 2006. During this period, the parties propose to provide the court with status
   statements at the end of February, March and April to confirm that constructive progress in this
   matter is continuing.

   settlement of this matter within the context of a broader strategic commercial relationship. The
   Parties anticipate the imminent execution of a confidential, nonbinding term sheet this week, as an

   Mooi duidelijk. Laten we zeggen dat we tot 13 januari 2007 geen deal hebben met CC, dan heeft het precies 1 jaar geduurd. Ondanks ik wel een stuk minder positief over het aandeel ben verkoop ik ze echt niet. In principe kunnen we nog zakken naar de 2,70, lager niet hoop ik. Over een jaartje naar de 10 dollar.

   Lijkt mij van niet. De term "draft agreement" betekent dat er voorstellen cq contracten zijn uitgewisseld tussen de partijen om tot een vergelijk te komen. Dit lijkt mij toch echt een andere statement dan "agressively moving forward"
   
   Als je al op het niveau van kontrakten bent uitgekomen (draft agreements)lijkt het mij dat men eind januari niets anders dan de deal kunnen bekendmaken. Lijkt ook niet meer dan logisch als je naar de eerdere opsomming van de zaak kijkt.

   Voor eind volgend jaar komt er helemaal niets, na de draft agreement komt er een final draft agreement, daarna draft agreement release candidate1 dan release candidate2, dan blijken er nog procudurele fouten in te zitten, al met al zo weer een jaar verder.

   Dat zou kunnen, maar dat betwijfel ik. Alle voorgaande keren is de kreet "draft agreement" niet genoemd en nu wel. Dat is toch wel hoopgevend! Overigens vind ik dat we met z'n allen niet teveel waarde moeten hechten aan die CC-deal. Waar het uiteindelijk toch omgaat zijn: zwarte cijfers.

   Om zwarte cijfers te schrijven,heb je wel deals nodig.Ik hoop niet, dat dat verhaal klopt van ragle 37 over draft agreement en dat er nog veel van die termen gaan volgen ,volgend jaar.Er zijn nog vele vragen waar de belegger geen antwoord op weet bv het schuiven van grote pakketten aandelen van de ene eigenaar naar de andere.Die veranderingen worden ook geregistreerd bij de(SeEC).Dat de koers van OpenTV gedaald is van 3 naar 2,50,is uitsluitend te wijten ,dat de verwachtingen weer te hoog gespannen waren.Zie ook het derde kwartaal 2005,wat er toen gebeurde met de koers na die cijfers.Neemt niet weg dat OpenTV op koers ligt en voor het eerst een positieve cash-flow en EBITDA in het derde kwartaal 2006 behaalde.

    Laten we dit draadje houden voor de Comcast settlement en vooruitgand voor de duidelijkheid.
    
    In de laatste UPDATES (lees niet meer uitstel) stond steeds nieuwe update. Indien settlement zou eerder uitsluitsel gegeven worden.
    
    Even een voorbeeldje, als Time Warner en Comcast dit schrijven voor de PRESS:
    
    "Comcast and Time Warner Cable did not respond to requests for information on their CableCard tests and deployment plans by press time"
    
    Wat maf je dan verwachten van Opentv??
    
    Maw, uitstel in deze is geen afstel.
    
    Opentv, IP (meeste in deze business), OCAP, Complexheid.
    
    Wie tot nu geduld had is wijs nog 4 maanden vol te houden. Alles is hier slechts mijn mening onderbouwd met feiten maar vooral geen beleggings advies.

    Cazan schreef nav het uitstel van de patentzaak:
    
    Nog 4 maanden volhouden ,uitstel is geen afstel,dit is geen beleggingsadvies.Voor de meesten geldt hier, dat de pot leeg(?) is ,om nog wat aandelen bij te kopen.De neerwaartse risico s zijn beduidend minder geworden op dit niveau(tussen de $2,40-$2,50).Dat is mijn eigen mening.Ook dit is geen beleggingsadvies.Of we de bodem gezien hebben op $2,40,is niet met zekerheid te zeggen.Ik dwaal weer af van het onderwerp van dit draadje,zie ik.

    Er blijft toch ontwikkeling inzitten. Over de formulering van zo'n update wordt goed nagedacht. Dus ook over het bijv. naamwoord "substantive", hetgeen m.i. aangeeft dat men echt serieus bezig is en serieuze vorderingen maakt. Vóór 2e helft 2007 verwacht ik een definitief, positief bericht.

    Een sterfhuis construktie schreef ragle37,de patentzaak maar wel een construktie van 100 miljoen.En die zullen op tafel moeten komen in contanten of in een deal.En dat laatste gaat het worden,wordt vanuit gegaan.Voor het eerst gaf een analist een tijdstip aan,in de eerste helft van 2006(KaufmanBros),enkele weken terug.Die patentzaak loop al een paar jaar,dus een paar maanden kan er ook nog wel bij.Het zit in het vat of het in contanten wordt uitgekeerd of in een deal wordt omgezet die 100 miljoen.Men heeft het steeds over dat het wat gecompliceerd is,invulling te geven aan de claim, met een deal.En zoals we weten gaat het over advertising.Daar ITV in ontwikkeling is,gaat het met die invulling ook wat langzaam.ITV moet goeddeels nog geaccepteerd worden door de consument.

    Die investor meeting heeft wellicht toch een grote Discovery a 7.9 miljoen aandelen opgeleverd.
